What is informed consent and what should I know before agreeing to surgery?

Informed consent requires the doctor to disclose the procedure, risks, alternatives and consequences in a language you understand. The Supreme Court in Samira Kohli (2008) made this a legal requirement.

What are the legal grounds for abortion (MTP) in India?

Under the Medical Termination of Pregnancy Act, 1971 (amended 2021), abortion is legal up to 20 weeks on one doctor's opinion and up to 24 weeks with two doctors' opinion in specified categories (rape survivors, minors, mentally ill, fetal abnormalities). Beyond 24 weeks needs Medical Board / court permission.

Can I make a living will / advance medical directive in India?

Yes — Supreme Court in Common Cause v. Union of India, (2018) 5 SCC 1 recognised the right to die with dignity and validated living wills (advance medical directives). 2023 guidelines simplified the procedure. Two witnesses + notary / gazetted officer; can be invoked if patient becomes incompetent.

How does organ donation and transplantation work legally in India?

Governed by the Transplantation of Human Organs and Tissues Act, 1994 (amended 2011). Living donation restricted to near relatives + emotional relations with state authorisation; deceased donation requires brain death certification by 4 doctors. Register via NOTTO. Sale of organs is criminal — up to 10 years imprisonment.

My hospital recommended an expensive treatment option and assured me the insurance would cover it. The insurer has now denied part of the claim. What can I do?

You have two overlapping claims — against the insurer for improper partial denial, and against the hospital for misrepresentation about coverage. If the hospital has acknowledged the error, get that admission in writing immediately. Challenge the insurer before the Insurance Ombudsman (free, binding, covers claims up to ₹50 lakh), and file a consumer complaint against the hospital for deficiency of service and unfair trade practice. The hospital cannot legally detain a medically discharged patient over an unresolved billing dispute.
