RERA / HIRA complaint fees, interest rates and authorities — compared across Indian states

Updated · 29 September 2026

Filing fees for an individual homebuyer's RERA complaint range from ₹1,000 (Delhi, Karnataka, Tamil Nadu, Telangana) to ₹5,000 (Maharashtra, residential). Most states apply the same delay-interest formula — SBI's Marginal Cost of Funds based Lending Rate (MCLR) + 2% — under the central RERA Act's Model Rules. West Bengal is the exception: it never adopted central RERA and runs its own law, WB-HIRA, with its own authority and portal.

Why does West Bengal stand out?

West Bengal is the only major state that did not notify rules under the central Real Estate (Regulation and Development) Act, 2016. It instead passed its own law — the West Bengal Housing Industry Regulation Act, 2017 (WB-HIRA) — with a separate authority and portal. The protections are broadly similar in spirit (delayed possession, refunds, plan-deviation complaints), but the fee schedule and some procedural details are set independently rather than following the central Model Rules that the other five states in this table largely mirror.

Why is Maharashtra's fee so much higher?

MahaRERA's ₹5,000/₹10,000 fee schedule is a state-specific decision, not a central requirement — most other states set individual-complainant fees at a flat ₹1,000 specifically to keep the forum accessible to ordinary homebuyers without needing a lawyer. Maharashtra's higher fee hasn't reduced its complaint volume — MahaRERA remains India's most active RERA authority by caseload, reflecting Mumbai and Pune's outsized share of the country's real estate disputes.

A note on figures that change

Filing fees, and occasionally the interest formula itself, are set by state notification and can be revised. The figures above were verified against each state authority's own current guidance at the time of writing (last updated below) — always cross-check the exact current fee on the specific state portal before filing, especially for West Bengal where source figures for the complaint fee have varied between ₹1,000 and ₹5,000 depending on the source consulted.
